Terms of Service

These Terms of Service (“Terms”) govern your access to and use of sailbuild.com and the call booking it offers (together, the “Site”), operated by SailBuild (“SailBuild”, “we”, “us” or “our”), an AI engineering studio operating from India.

By using the Site or booking a call, you agree to these Terms. If you do not agree, please do not use the Site.

1. The Site is not an offer

Nothing on the Site is a contract for paid work, and nothing on it is an offer capable of acceptance. Descriptions of services, stages and timescales are provided for information. Prices, scope and schedules discussed on a call are indicative until they are set out in writing and signed.

2. Booking a call

• A booking reserves a time in our calendar. It is free, and it commits neither party to anything beyond attending.
• You may cancel at any time before the call starts, from the booking page, using the email address the booking was made with.
• We may cancel or reschedule a call, and will tell you as soon as we reasonably can.
• We may decline or withdraw access to booking where it is misused, including repeated bookings that are not attended, automated booking, or bookings made to reserve time in bad faith.
• You agree that the information you provide when booking is accurate, and that the email address is one you are entitled to use.

3. Paid work

Paid work begins only when both parties have signed a written proposal or statement of work. That document sets the scope, fees, schedule, acceptance criteria and any terms specific to that engagement, and it prevails over these Terms and over anything said on a call or published on the Site. Where a fixed quote follows a paid discovery stage, the proposal states how long the quote remains open.

4. Acceptable use

You may read, share and quote the Site. You may not attempt to gain unauthorised access to it, disrupt it, probe it for vulnerabilities without our written permission, collect data from it at a volume that degrades it for others, or use it or any address obtained from it to send unsolicited messages.

5. Intellectual property

The text, design, graphics, code and other content of the Site are owned by SailBuild or its licensors and are protected by applicable intellectual property laws. These Terms grant no licence to that content beyond viewing and ordinary personal or internal business use. Ownership of deliverables created during paid work is dealt with in the proposal for that engagement.

6. Your material and confidentiality

Material you send us so we can understand or quote for your problem, including documents, data, credentials or access to a system, remains yours. We treat it as confidential, use it only to answer your question or perform the work, and return or delete it on request. Where an engagement requires a separate non-disclosure agreement, we will sign one.

7. Third-party services

The Site relies on third-party services, including calendar, video conferencing, database, hosting and email providers. Their availability is outside our control, and their own terms apply to your use of them.

8. Disclaimers

The Site is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure or error free. Content on the Site is general information, not advice for your particular circumstances.

9. Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Subject to that, and to the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or goodwill, arising out of or in connection with your use of the Site. Our total liability arising from the Site is limited to one hundred United States dollars. Liability in respect of paid work is governed by the proposal for that engagement.

10. Indemnity

You agree to indemnify SailBuild against claims, losses and reasonable costs arising from your misuse of the Site or your breach of these Terms.

11. Privacy

Our handling of personal information is described in the Privacy Policy, which forms part of these Terms.

12. Changes

We may update these Terms. The date above shows when they last changed, and the version in force is the one published at the time you use the Site. Continued use after a change takes effect constitutes acceptance of the updated Terms.

13. Severability and waiver

If any provision of these Terms is held to be unenforceable, the remaining provisions continue in force. A failure to enforce a provision is not a waiver of it.

14. Governing law

These Terms are governed by the laws of India, and the courts of India have exclusive jurisdiction over any dispute arising from them. Nothing here removes any right you have under the law of the country in which you live that cannot be given up by agreement.
